The term “tender” is increasingly used in modern Russian reality. In the article we will tell you what it is, how to take part in a state competition or auction, and what conditions must be met in order to submit an application and become the winner of the tender.

What is a state tender and what documents regulate the scope of public procurement?

The concept itself comes from the English tender, which means “offer”. A tender is a competitive form of selection of proposals for the supply of goods, services or works under pre-announced conditions, within a specified time frame, on the principles of fairness and competition. Speaking in simple language, the tender involves one buyer of a product or service and several sellers, the winner is the company that offers the most favorable conditions to the customer.

In Russia, the term is not fixed at the legislative level, but its legally significant alternatives are the concepts: auction, competition (less often - request for quotations and request for proposals).

A distinctive feature of the concepts of “competition” and “auction” is that during the latter, participants can change the offer price to a more profitable one in order to get ahead of a competitor. Participants in the competition do not have this opportunity - the customer selects a worthy candidate based on the terms of the contract.

The public procurement process is regulated by the Federal Law of 04/05/2013 No. 44-FZ “On the contract system in the field of procurement of goods, works, services to meet state and municipal needs” (hereinafter referred to as 44-FZ) and the Federal Law of 07/18/2011 . No. 223-FZ “On the procurement of goods, works, services of certain types legal entities"(hereinafter referred to as 223-FZ). Certain issues of application of laws are enshrined in additional regulatory documents, for example, in Government Decree No. 1005 dated 08.11.2013 and others.

Note that 44-FZ applies to any government procurement and government customers and regulates every stage of the transaction. The law specifies requirements for organizers and participants of competitions and auctions, securing applications, specifies fines for violating regulations, etc. Companies and organizations in which a controlling stake belongs to the state are subject to 223-FZ. The law does not detail the bidding procedure, giving only general recommendations to participants and defining key principles. Thus, according to 223-FZ, it is not necessary to justify purchases and the initial price of the contract; in addition, the conditions for participants can be set by the customers themselves.

Features of participation in state competitions

When it is necessary to implement something technically complex, for example, construction work that requires professional execution, customers hold a competition. The key point when holding a competition is not the price, but the financial stability of the contractor, his qualifications and the characteristics of the subject of purchase offered by him.

According to Article 24 of 44-FZ, competitive methods for determining performers are:

  • Open competition. The most common one, any supplier can take part in it. An open competition lasts at least a month, information about its beginning is published in a special unified information system. Requirements for suppliers and the subject of purchase (product or service), applications for participation, criteria for determining the winner are prescribed in the competition documentation. The opening of envelopes with participants' proposals, as well as the announcement of the results, is carried out publicly, and the applications are assessed by the competition commission. A contract is concluded with the participant who submits the most advantageous offer.
  • Competition with limited participation. The procedure is similar to an open competition. A notice of its holding is published in a unified information system for a limited circle of persons, but paragraph 2 of Article 56 of 44-FZ provides for only two cases of holding such a competition:
    1. If it is necessary to supply goods, perform work, provide services that, due to their technical and technological complexity, innovative, high-tech or specialized nature, can only be carried out by performers with the required level of qualifications.
    2. If it is necessary to carry out work to preserve cultural heritage sites (historical and cultural monuments), restore museum objects and collections, especially valuable and rare documents included in library collections.

    On prequalification Participants are subject to not only general but also additional requirements, which include:

    • Financial resources for contract execution.
    • Availability of equipment and other material resources (on the right of ownership or other legal basis) for the execution of the contract.
    • Work experience related to the subject of the contract.
    • Positive business reputation.
    • The required number of qualified specialists to execute the contract.
  • Two-stage competition. It is an open competition with pre-qualification selection. Participants who have passed the first stage, in the second stage, must offer the most interesting conditions for the execution of the contract in order to win. Customers conduct a two-stage competition while simultaneously complying with the following conditions:
    • The competition is held to conclude a contract for scientific research, design work(including architectural and construction design), experiments, research, for the supply of innovative and high-tech products, energy services, as well as for the purpose of creating a work of literature or art.
    • To clarify the characteristics of the procurement object, it is necessary to discuss it with the procurement participants.
  • Closed competition. The rules for participation and holding a closed competition are the same as for an open competition. The only difference is the procedure for selecting participants. Information about the opening of the competition and its results is not public; only those performers who have received an invitation from the customer can take part. A closed competition is held when it is necessary:
    • Procurement for the needs of the state, information about which is a state secret.
    • Procurements that constitute state secrets, if information about this is contained in the procurement documentation.
    • Procurement of services for insurance, transportation and protection of valuables of the State Fund of Precious Metals, museum objects and museum collections, rare and valuable publications, manuscripts, archival documents.
    • Procurement of cleaning services and driver services for the activities of judges and bailiffs.
  • Closed competition with limited participation. The customer sends an invitation to participate in the competition to a limited number of persons who meet the requirements. The winner is the contractor who offered the best conditions for fulfilling the contract and passed the pre-qualification selection. Conducting a closed tender with limited participation complies with the provisions of the law on open tender with limited participation and the provisions on conducting a closed procedure for identifying suppliers.
  • Closed two-stage competition. Information about its implementation and tender documentation are also sent to a limited circle of persons who can fulfill government orders in cases where closed types of procurement are used. The competition consists of two stages. At the first stage, the customer reviews applications in which the price is not indicated, clarifies the characteristics of the subject of procurement and the criteria for evaluating participants, after which it sends modified documentation and an invitation to suppliers to participate in the second stage. At the second stage, applications are accepted with an indication of the cost; the winner is the participant who offered the best terms for the execution of the contract.

The choice of the type of competition depends on the tasks assigned to the customer. Thus, open procurement is carried out to attract a large number of suppliers, including small and medium-sized companies. Competitions with limited participation are aimed at obtaining a product or service best quality, and two-stage ones allow the subject of procurement to be brought up for discussion and the requirements for it to be detailed during the bidding process.

Features of participation in government auctions

When the customer clearly knows what quality and in what time frame he wants to receive a product, work or service, but the only and most important criterion remains - a favorable price, it would be appropriate to hold an auction.

Article 24 44-FZ identifies the following types of auctions:

  • Closed auction. Information about it is not always published in a unified information system. The customer sends invitations to suppliers who meet the requirements. The winner is the participant who offers the most favorable price. Since competition is limited due to a closed form of conduct, the law establishes that such purchases are made in the following cases:
    • For federal needs that constitute state secrets.
    • For insurance and transportation of precious stones and metals belonging to Russian Federation, including items from museum collections of historical and cultural significance.
    • To provide cleaning services, driver services to support the activities of judges and bailiffs.
  • State electronic auction (auction in electronic form). An open auction, information about which is posted in a unified information system for an unlimited number of persons. Conducted on electronic trading platforms (ETP). Suppliers, in order to participate, must have electronic signature and site accreditation. The winner is the participant who offered the most favorable price to the procurement object.

State trading platforms

Today, the most common type of government tenders is an electronic auction. Information about such procurements, including the program and list of tenders, can be found on the official state portal of the Unified Information System in the field of procurement zakupki.gov.ru, but we will talk about trading platforms. So, the official platforms for electronic trading are:

  • CJSC Sberbank-AST- sberbank-ast.ru. A subsidiary of Sberbank of Russia, the most popular ETP.
  • JSC "Unified Electronic Trading Platform"- etp.roseltorg.ru. The site is also known as Rosseltorg. It was originally created for customers from Moscow. Currently it provides the largest number of related services to customers and bidders.
  • "Zakaz RF - Purchasing module for budget purchases"- etp.zakazrf.ru. The recently emerged ETP for servicing government procurement, which has retained the address and professional approach of one of the oldest electronic platforms - the State Unitary Enterprise "Agency for government order RT". The largest customer is the government of Tatarstan.

Nuances of holding joint competitions and auctions

In cases where two or more customers purchase the same goods or services, they can hold joint tenders and auctions. Customers must enter into an agreement among themselves before the approval of the tender or auction documentation. The organizer is responsible for conducting procurement, to whom customers transfer by agreement part of their powers: posting information about the tender in a unified information system, approving the composition of the procurement commission, and others. Each customer enters into a contract with the winner or winners independently.

Conditions for participation in government tenders

According to the law, a tender participant can be any legal or individual, including individual entrepreneurs, subject to compliance with customer requirements. These requirements are also specified in the law and are the same for all participants. These include:

  • the participant does not have arrears in taxes and debts or has compelling reasons to justify such debt;
  • the participant has no criminal record economic sphere except in cases where the criminal record has been withdrawn or expunged;
  • the presence of copyrights to the results of intellectual activity (the exception here is contracts for the creation of works of literature or art, for financing the distribution or screening of a national film);
  • the absence of a conflict of interest between the participant and the customer (for example, the top officials of the customer are related to the top officials of one of the tender participants, while suppliers - procurement participants must be in an equal position);
  • lack of registration of the supplier company in an offshore zone;
  • absence of the participating company in the register of unscrupulous suppliers;
  • absence of a court decision on bankruptcy, liquidation or suspension of the activities of the participating company;
  • the possibility of providing a fixed sum of money or a bank guarantee as financial security for an application for participation in a state competition.

As we found out, state tender is a broad concept. It is not easy to understand all its nuances, especially for start-up companies. Meanwhile, the outcome of the competition largely depends on how correctly you prepare the package of documents and submit your application. The solution may be either to organize a tender department or to outsource some tender issues. Most often, the issue of providing financial support for an application for participation in a state competition is resolved in this way.
